JJM Nails currently operates self-serve JJM Nails stations at the following locations in Victoria, Australia: World Trade Centre, 18–38 Siddeley St, Docklands VIC 3005, and DFO Moorabbin, 250 Centre Dandenong Rd, Moorabbin Airport VIC 3194. You may also purchase JJM Nails products via our website at jjmnails.com. Our registered business and ABN details will be made available on our website and order documentation so that you know who you are contracting with.

By using this website, by purchasing products online, or by purchasing products from any JJM Nails station, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions as amended from time to time. If you do not agree to these Terms and Conditions, you must not access the website or purchase our products. We may update or amend these Terms and Conditions at any time without prior notice. Any changes will take effect from the date they are published on the website, and your continued use of the website or purchase of products after changes are published will constitute acceptance of the updated Terms and Conditions.

JJM Nails supplies cosmetic nail products, including press-on or clip-on nail sets and related accessories, for aesthetic and personal grooming purposes only. Our products are not therapeutic goods and are not intended to diagnose, treat, cure or prevent any medical condition. We aim to describe and display our products as accurately as possible; however, colours, finishes and details may appear differently between devices, screens and lighting conditions, and packaging and design details may be improved or updated from time to time so that minor variations may occur between photographs and the final product. All product information, including sizing guidance and wear-time estimates, is provided as a general guide only. Individual results may vary depending on nail preparation, application technique, natural nail type, daily activities and aftercare. We may amend, update, discontinue or replace products at any time without prior notice.

Unless stated otherwise, all prices displayed on the website are in Australian Dollars (AUD) and are inclusive of Australian Goods and Services Tax (GST) where applicable. We reserve the right to change prices, introduce new products or modify promotions at any time. If a pricing error is identified after you have placed an order, we may contact you to confirm whether you wish to proceed at the correct price; if you choose not to proceed, or if we are unable to contact you, we may cancel your order and arrange a refund to your original payment method. Promotional offers, discount codes and sales are subject to their own specific terms and may be withdrawn or modified at any time, and they generally cannot be applied retrospectively to completed orders unless required by law.

When you place an order through the website, you are making an offer to purchase the selected products in accordance with these Terms and Conditions. Submitting an order and receiving an automatic confirmation email does not guarantee acceptance of your order. We reserve the right to accept or reject any order in our absolute discretion, including where a product is unavailable, a pricing or description error is identified, or we reasonably suspect fraudulent or unauthorised activity. Payment must be made in full at the time of ordering using the payment methods made available at checkout, and you warrant that the payment information you provide is accurate, complete and authorised. Payments are processed by third-party payment providers. JJM Nails does not store your complete card details and is not responsible for any errors, delays, fees or losses arising from the use of these third-party services, except to the extent required by law. If we reject or cancel an order after payment has been processed, we will refund the amount paid to your original payment method as soon as reasonably practicable.

We aim to dispatch orders promptly. Orders placed and successfully paid for before 12:00 pm (midday) on a business day are generally dispatched on the same business day, and orders placed after 12:00 pm (midday) are generally dispatched on the next business day. Business days are Monday to Friday, excluding public holidays in the relevant dispatch location. Dispatch timeframes are indicative only; during busy periods, promotional events, public holidays or unforeseen disruptions, dispatch may take longer and we are not responsible for delays that are outside our reasonable control. Once dispatched, your order will be handled by a third-party delivery carrier. Delivery timeframes vary depending on your location, chosen shipping method and carrier performance, and any delivery estimates are indicative only and are not guaranteed. To the extent permitted by law, we are not liable for delays caused by postal or courier services. You are responsible for providing an accurate and complete delivery address. If an order is returned to us because the address is incorrect, incomplete or unattended, we may require payment of additional shipping charges to re-send the order.

Risk in the products, including risk of loss, damage or deterioration, passes to you when the order is delivered to the delivery address you provide, or when you or your nominated person collects the order. Title in the products passes to you only when full payment for the order has been received and processed by JJM Nails.

For hygiene and safety reasons, and to comply with health standards relating to cosmetic and personal-use products, JJM Nails does not offer change-of-mind returns or refunds for nail sets once they have left our control, except where required under the Australian Consumer Law. You should therefore choose carefully before purchasing and review product details and imagery before confirming your order. We take care to ensure that your order is packed correctly and that products are fit for purpose at the time of dispatch. If you believe that an item is faulty, damaged in transit, or incorrect compared with your order, you must contact us as soon as possible. If your products appear faulty or incorrect, you must email us at admin@jjmnails.com within fourteen days of receiving your order. In your email, you should include your order number, a clear description of the issue and, where possible, photographs showing the fault, damage or incorrect item. We may request that you return the item to us for inspection. Where we reasonably determine that the product is faulty, damaged or incorrect and that you are entitled to a remedy under the Australian Consumer Law, JJM Nails will cover the reasonable cost of return postage and will provide an appropriate remedy, which may include repair, replacement, a refund to your original payment method, or a store credit, depending on the nature of the failure and what the law requires. To be eligible for a remedy, products should be returned in their original packaging and in good, unused condition, except to the extent necessary to inspect the product and identify the fault.

Where a refund is approved for a faulty, damaged or incorrect product, we may refund to your original payment method or issue a store credit at your election, subject to what is required under the Australian Consumer Law. Store credits are issued in Australian Dollars, are valid for the period specified at the time of issue and may be used towards future purchases on the website. Store credits cannot be redeemed for cash and cannot be transferred, sold or exchanged, except where required by law. Once a store credit has been chosen and applied, it cannot generally be converted back into a cash refund unless required under the Australian Consumer Law.

JJM Nails currently offers one general size range designed to fit most nail shapes and lengths. Each set contains a variety of nail widths so that you can select the best fit for each finger, and you may lightly file or shape the sides or tips of nails for a more custom fit. If you find that the sizing or fit of your nails is not suitable, you may contact us at admin@jjmnails.com to discuss whether an exchange is possible. Subject to our assessment and to our obligations under the Australian Consumer Law, we may offer an exchange for another nail set of the same price, provided that the items are returned in original packaging, in good, unused condition and within a reasonable period. Unless otherwise required by law, you may be responsible for any postage or shipping costs associated with returning items for a change-of-size exchange, and we will confirm applicable costs and conditions at the time you contact us. Nothing in this paragraph limits your statutory rights under the Australian Consumer Law in relation to faulty products.

In addition to online sales, JJM Nails products are available via self-serve JJM Nails stations at World Trade Centre, Docklands, and DFO Moorabbin, Moorabbin Airport, in Victoria. When you purchase from a JJM Nails station, you should review the sizing information, pricing and product details displayed on the station screen or signage before confirming your selection. As these are self-serve locations, it is your responsibility to select the correct product. The same general principles in these Terms and Conditions apply to purchases from JJM Nails stations, including that change-of-mind returns are not available, but your Australian Consumer Law rights in respect of faulty or incorrect products remain.

All content on the website and in our branding, including text, graphics, logos, photographs, product names, collection names, layouts, icons, button designs and overall look and feel, is owned by or licensed to JJM Nails and is protected by copyright, trade mark and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the website for personal, non-commercial purposes only. You must not reproduce, distribute, modify, adapt, publish, display, sell, license or create derivative works from any content on the website without our prior written consent, except as permitted under applicable copyright laws. Use of our trademarks, including “JJM Nails” and any associated logos or collection names, is strictly prohibited without our express written permission.

You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else’s use of the website. To the maximum extent permitted by law, and subject always to your non-excludable statutory rights, JJM Nails does not accept liability for any indirect, consequential, special or punitive loss or damage, or for loss of profits, revenue, opportunity or data arising out of or in connection with the use of the website or the purchase or use of our products, and limits its liability for breach of any non-excludable condition or warranty to, at our option, the replacement of the goods, the supply of equivalent goods, the repair of the goods, or the payment of the cost of such replacement, supply or repair, as permitted by section 64A of the Competition and Consumer Act 2010 (Cth). You are responsible for proper application, use and removal of JJM Nails products. We are not liable for damage to natural nails, allergies, irritation or reactions arising from improper use, failure to follow instructions, pre-existing conditions or use contrary to our guidance, except where we cannot exclude or limit liability under the Australian Consumer Law.
